1. Introduction

Welcome to GoAspire, a product by GoAspire Sdn Bhd ("GoAspire", "we", "us", or "our"), designed to help individuals and teams assess their potential and performance through our WorkStyles assessment platform. By accessing or using GoAspire, you agree to the terms outlined below. If you do not agree, you may not use the service.

2. Acceptance of Terms

By signing up for GoAspire, you agree to these Terms of Service. GoAspire reserves the right to update these terms. You will be notified of changes and required to agree to them at your next login.

3. Service Description

GoAspire provides the WorkStyles assessment platform and related services to help individuals and teams understand their work preferences, behavioural styles, and potential. Our services include individual assessments, team reports, and facilitated workshops.

4. Eligibility

You must be at least 18 years old or have the legal capacity to enter into contracts under Malaysian law to use this service. If you are using the service on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

5. Intellectual Property

All assessments, algorithms, methodologies, insights, reports, and related materials provided by GoAspire are the exclusive property of GoAspire Sdn Bhd and are protected under Malaysian intellectual property laws.

• Users are granted a limited, non-transferable license to use these materials solely within the GoAspire platform for their intended purpose
• Unauthorised reproduction, distribution, reverse engineering, or creation of derivative works is strictly prohibited
• The WorkStyles name, logo, and related branding are trademarks of GoAspire Sdn Bhd

6. Data Ownership and Accuracy

All data submitted by users is processed in accordance with our Privacy Notice and the Personal Data Protection Act 2010 (PDPA).

• Users retain ownership of the personal data they submit
• GoAspire is granted a license to process this data to provide the services
• Users are responsible for the accuracy and completeness of the data they provide
• GoAspire is not liable for inaccurate insights resulting from incorrect user input

7. Prohibited Actions

Users agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of GoAspire
• Share access credentials with unauthorised parties
• Scrape, copy, or otherwise misuse the assessments, insights, or algorithms
• Use the service in a way that infringes on intellectual property or violates applicable Malaysian laws
• Attempt to gain unauthorised access to our systems or other users' accounts
• Use the service to discriminate against individuals in employment or other decisions

8. Payment and Refunds

GoAspire operates on a transactional and subscription-based model. All fees are quoted in Malaysian Ringgit (MYR) unless otherwise specified. Payment terms are as follows:

• Payment is due at the time of purchase or as specified in the subscription agreement
• All payments are subject to applicable Malaysian taxes including Sales and Service Tax (SST)
• Refunds may be provided at GoAspire's discretion within 14 days of purchase if services have not been substantially used
• Subscription cancellations will take effect at the end of the current billing period

9. Termination of Service

GoAspire reserves the right to terminate or suspend accounts for any reason, including but not limited to:

• Violations of these Terms of Service
• Non-payment of fees
• Fraudulent or illegal activity
• Extended periods of inactivity

Upon termination, your access to the service will cease and your data will be handled in accordance with our Privacy Notice.

10. Privacy and Data Protection

GoAspire collects and processes personal data in accordance with the Personal Data Protection Act 2010 (PDPA) and our Privacy Notice.

• By using our services, you consent to the collection and processing of your personal data as described in our Privacy Notice
• You have rights under the PDPA including the right to access, correct, and withdraw consent for processing of your personal data
• GoAspire may share anonymised or aggregated data for research and benchmarking purposes

11. Limitation of Liability

GoAspire takes all reasonable steps to secure user data and ensure reliable service. However, to the maximum extent permitted by Malaysian law:

• GoAspire provides the service "as is" without warranties of any kind
• GoAspire is not liable for indirect, incidental, special, or consequential damages
• GoAspire's total liability shall not exceed the amount paid by you for the services in the 12 months preceding the claim
• GoAspire is not liable for decisions made based on assessment results

12. Indemnification

You agree to indemnify and hold harmless GoAspire Sdn Bhd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these terms.

13. Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of Malaysia.

• Any disputes arising from these terms or the use of our services shall first be attempted to be resolved through good faith negotiation
• If negotiation fails, disputes shall be resolved through mediation administered by the Asian International Arbitration Centre (AIAC) in Kuala Lumpur
• If mediation fails, disputes shall be finally resolved by arbitration under the AIAC Arbitration Rules
• The language of arbitration shall be English

14. Modifications

GoAspire reserves the right to modify these terms at any time. Users will be notified of material changes via email or through the platform. Your continued use of the service after such changes constitutes acceptance of the updated terms.

15. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid under Malaysian law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Governing Language

These Terms of Service are provided in both English and Bahasa Malaysia. In the event of any inconsistency between the English and Bahasa Malaysia versions, the English version shall prevail.
